The absence of a complainant made a Grade 1 Area Court in AsoPada, Mararaba, to strike out the case of alleged theft against a bus conductor, Peter Samuel.
The Presiding Judge, Mr Albert Maga, discharged the accused after the prosecutor, PC Friday Adaji, filed an application for the case to be struck out following the complainant’s absence during three court sessions.
Adaji said the complainant informed him that she had been transferred to Lagos and urged the court to strike out the case.
Earlier, the prosecutor told the court that the case was reported at the `A’ Divisional Police Station in Mararaba on March 30.
The prosecutor added that the accused snatched the complainant’s Tecno handset valued at N10, 000 at Aso junction while she was returning from work.
He said the handset was found in the possession of the accused when he was arrested.
Adaji said the offence contravened the provisions of Section 288 of the Penal code. (NAN)
