The Senior Magistrate Court 11 in Damaturu, Yobe state capital, presided over by Gambo A. Ibrahim, has sentenced a 32 year-old businessman, Babagana Abba, for breach of trust.
The Police prosecutor, Cpl. Zakar Saleh Lampo, told the court that on or about two years ago, the accused person was entrusted with some goods, mattresses, by one Obinna Festus, a resident of Maiduguri, Borno state for him to sell.
He told the court that the accused person was allowed to sell the foams and take his commission on each of the foam sold, adding further that after selling out the foams, worth N1.030, 000, the accused person converted the money to his own personal use.
The prosecutor said the offence committed by the accused person is punishable under section 314 of the Penal Code law.
In his judgment, the presiding judge, Gambo A. Ibrahim, after considering that the convicted person was a first time offender while also taking regard for the plea made by the convicted person, who earlier paid the sum of N50, 000, promising to pay the balance of the sum of money in his trust, sentenced him to six months imprisonment or to pay a fine of N2, 500.
The judge, however, warned the convict that he risks an imprisonment of another three years if he failed to pay up as he has promised and would equally be required to pay the balance thereafter.
